CRIMINAL DEFENSE / OFFENSE GUIDE

Expungement & record relief

A past case can continue to affect employment and other opportunities. California offers several forms of record relief, each with its own rules and limits.

Understand the allegation.

A dismissal under Penal Code section 1203.4 is often called expungement. Other options may include reduction, arrest-record sealing, juvenile-record sealing, or relief under different statutes, depending on the history.

Issues to examine

The complete criminal history; the statute of conviction; the sentence and probation record; pending charges; prior relief; and the purpose for which relief is being sought.

What may be at stake

A dismissal does not necessarily erase or seal all records, restore firearm rights, or eliminate every disclosure obligation. Immigration, licensing, and registration issues may require separate analysis.

A practical next step

Obtain the case number, charging and sentencing records, and proof of completion of court requirements if available. Eligibility and the appropriate procedure must be assessed for the particular record.
