CIVIL LITIGATION / DEFENSE GUIDE

Early case assessment & motion strategy

The first phase should identify what is urgent, which issues may narrow the case, and what information is worth collecting now.

Build a plan around decisions.

An effective response starts with the complaint, service history, parties, court, and requested relief. Establish deadlines and identify related disputes. Then distinguish legal issues that may be presented early from factual questions that require discovery. The right sequence depends on the forum and the allegations.

Threshold questions

Assess jurisdiction, venue, service, standing, timeliness, contractual forum or arbitration provisions, and the sufficiency of each claim. Motions should serve a defined purpose and account for amendment opportunities, timing, cost, and possible effects on the rest of the case.

Urgent business needs

A temporary restraining order or preliminary injunction request can compress the timetable. Identify the challenged conduct, immediate business effects, available declarations and documents, and the relief sought. Promptly assess the court’s procedures and any need for emergency action.

A realistic initial assessment

Compare what the pleadings allege with documents the company can locate quickly and reliably. Record material uncertainties rather than filling gaps with assumptions. Identify the facts most likely to change the assessment and the cost of obtaining them.

Reassess at milestones

An initial motion, amended pleading, important production, or certification decision may change the strategy. Update exposure, budget assumptions, and resolution options at those points so management can make decisions with current information.

A practical next step

Send counsel the complete pleadings, summons, service information, orders, and hearing notices promptly. Identify potentially applicable insurance and documents that may be lost through ordinary retention practices.
