CIVIL LITIGATION / DEFENSE GUIDE

Consumer & product-related class actions

Advertising, labeling, pricing, and product allegations can reach across customers, channels, and years of sales. A precise account of the business practices is essential.

Understand the transaction before defining the dispute.

Consumer cases may involve alleged misleading statements, omitted information, disputed fees, warranty issues, or product performance. The defense should identify exactly which representation, product, transaction, and time period the plaintiff challenges. Applicable consumer statutes and available remedies vary by jurisdiction.

Identify what customers actually encountered

Collect dated labels, packaging, web pages, marketing approvals, product versions, sales terms, and distribution records. A single current screenshot may not establish what was available throughout the proposed class period or across every sales channel.

Examine differences across the proposed class

Purchasing circumstances, exposure to a statement, product use, state law, alleged injury, and proposed damages can present different issues. Test whether the plaintiff’s theory and evidence address those differences and the particular legal requirements of the claims.

Connect expert work to a question

Technical, survey, or economic analysis should address a defined issue: what the challenged language conveys, how a product performs, or whether a proposed damages model matches the alleged injury. Evaluate assumptions and available data before incurring substantial expert costs.

Plan for operational effects

Litigation can affect packaging, customer service, retailer relationships, and product communications. Review proposed business changes with counsel in context; a prospective change does not by itself resolve existing claims or establish a defense.

A practical next step

Preserve historical versions of claims and sales materials, substantiation records, complaints, return information, and relevant transaction data. Identify gaps in records and who can explain how the materials were used.
